AGREEMENT TO OUR LEGAL TERMS

We are Lipták Lóránt E. V. (“Company,” “we,” “us,” or “our“), a business registered in Hungary, operating the website https://simphonia.net (“Site“).

These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you“), and Lipták Lóránt E. V., concerning your access to and use of the Site and the purchase of eSIM data products offered through it. By accessing the Site, you confirm that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. OUR SERVICES


The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

We offer international eSIM mobile data packages for travel, available in 200+ countries and regions in various durations and data sizes (from 1 GB / 1 day up to Unlimited / 30 days). Our eSIM products provide data connectivity only — they do not include SMS messaging, voice calls, or a phone number. All eSIM products are delivered digitally via QR code or activation code to your registered email address.


2. INTELLECTUAL PROPERTY RIGHTS


We are the owner or the licensee of all intellectual property rights in our Site, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content“), as well as the trademarks, service marks, and logos contained therein (the “Marks“).

The Content and Marks are provided on the Site “AS IS” for your personal, non-commercial use or internal business purpose only. No part of the Site, Content, or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.


3. USER REPRESENTATIONS


By using the Site, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Site through automated or non-human means, whether through a bot, script, or otherwise; (4) you will not use the Site for any illegal or unauthorized purpose; (5) your use of the Site will not violate any applicable law or regulation; and (6) the device you intend to use is eSIM compatible and unlocked. It is your responsibility to verify device compatibility before purchase.


4. PRODUCTS AND ESIM SERVICES


We reserve the right to limit the quantities of any products or services we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us.

Please note the following limitations that apply to all eSIM products sold on the Site:

  • Data only: eSIM packages do not include voice calls, SMS, or a phone number.
  • Device compatibility: Your device must support eSIM technology and must not be carrier-locked. Check compatibility before purchase.
  • Single installation: eSIM QR codes can only be scanned and installed once. The code is rendered void after first use.
  • Validity period: Data validity starts from the date of first use in the destination country, not the purchase date, unless stated otherwise on the product page.
  • Network availability: Coverage depends on local network partners. We do not guarantee uninterrupted or error-free connectivity.


5. PURCHASES AND PAYMENT


We accept major credit/debit cards and other payment methods as displayed at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

All prices are displayed in EUR (€) unless otherwise noted. Prices are inclusive of applicable taxes where required by law. We reserve the right to refuse any order placed through the Site. Payment must be received in full before an eSIM is delivered to your email.


6. REFUND POLICY


Due to the digital and instant-delivery nature of eSIM products, all sales are final once the eSIM QR code or activation details have been delivered to your email address. We do not offer refunds for activated or installed eSIMs, or for eSIMs that have been displayed or used, even partially.

Exceptions — a refund or replacement may be offered at our sole discretion in the following cases:

  • The eSIM QR code was never delivered to your email and the issue cannot be resolved within 48 hours of purchase.
  • The eSIM was delivered but is technically non-functional due to a confirmed error on our side or our supplier’s side, and you have not yet installed or attempted to use the eSIM.

To request a refund or report an issue, contact us within 7 days of purchase at privacy@simphonia.net with your order number and a description of the issue.


7. PROHIBITED ACTIVITIES


You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data or content from the Site to create a database or collection without written permission.
  • Trick, defraud, or mislead us or other users, especially in any attempt to learn sensitive account information.
  • Circumvent, disable, or otherwise interfere with security-related features of the Site.
  • Use any information obtained from the Site in order to harass, abuse, or harm another person.
  • Resell or redistribute eSIM codes purchased on the Site without our prior written consent.
  • Use the Site in a manner inconsistent with any applicable laws or regulations.


8. THIRD-PARTY SERVICES


The Site may contain links to third-party websites, and some of our products are fulfilled through third-party eSIM providers (including but not limited to Airalo). These third-party services are governed by their own terms and privacy policies, and we are not responsible for their content, policies, or practices. We encourage you to review the terms and privacy policies of any third-party services you use.

Any issues related to underlying network performance, roaming restrictions, or carrier-level access are subject to the terms of the third-party eSIM provider. We will make reasonable efforts to assist in resolving such issues but cannot guarantee outcomes.


9. DISCLAIMER OF WARRANTIES


THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranties or representations about the accuracy or completeness of the Site’s content, and we assume no liability for any (1) errors, mistakes, or inaccuracies of content; (2) service interruptions; (3) unauthorized access to or use of our servers; (4) any interruption or cessation of transmission to or from the Site; or (5) any bugs, viruses, or the like.


10. LIMITATION OF LIABILITY


IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. CERTAIN CONSUMER PROTECTION LAWS OF YOUR JURISDICTION MAY NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY.


11. INDEMNIFICATION


You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Legal Terms; (3) any breach of your representations and warranties set forth in these Legal Terms; (4) your violation of the rights of a third party; or (5) any overt harmful act toward any other user of the Site.


12. GOVERNING LAW


These Legal Terms are governed by and interpreted following the laws of Hungary, and the use of the United Nations Convention of Contracts for the International Sales of Goods is expressly excluded. If your habitual residence is in the EU, and you are a consumer, you additionally possess the protection provided to you by obligatory provisions of the law of your country of residence.


13. DISPUTE RESOLUTION


Informal Negotiations. To expedite resolution and control the cost of any dispute, controversy, or claim related to these Legal Terms (each a “Dispute”), the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other at privacy@simphonia.net.

EU Online Dispute Resolution. The European Commission provides an Online Dispute Resolution platform, which you can access at https://ec.europa.eu/consumers/odr. If you are an EU consumer, you may also use this platform to seek resolution of your dispute.


14. CORRECTIONS


There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.


15. MISCELLANEOUS


These Legal Terms and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision. These Legal Terms operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
